Welcome to Toes First. These Terms of Service (“Terms”) govern your access to and use of our website, online store, and the purchase and use of the Toes First handheld sock assist device (“Product”). By accessing our website or purchasing our Product, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Product Description & Important Notice

The Toes First device is a handheld sock assist tool designed to help adults put on socks more comfortably and efficiently.

Important:

  • The Toes First device is NOT a medical device.

  • It is not intended for medical, therapeutic, rehabilitative, or post-surgical use.

  • Individuals recovering from surgery, experiencing medical mobility limitations, or advised by a healthcare provider not to use assistive devices should not use this product.

  • Use of this product is at your own risk.

2. Eligibility

By using this website or purchasing our Product, you confirm that you:

  • Are at least 18 years of age; or

  • Are using the website under the supervision of a parent or legal guardian.

  • Are purchasing for personal, non-commercial use unless otherwise agreed in writing.

3. TERMS OF SALE (NO RETURNS / NO REFUNDS)
ALL SALES ARE FINAL.

Due to the nature of this product, we do not offer refunds, returns, exchanges, or cancellations once an order has been placed.

Please review your order carefully before completing your purchase.

By completing your transaction, you acknowledge and agree that:

  • You understand the product description.

  • You accept that all sales are final.

  • You waive any right to chargebacks based on dissatisfaction or buyer’s remorse.

Toes First reserves the right to refuse service or cancel orders at our discretion.

4. Pricing, Tax & Shipping Disclosure (Buy Button Orders)

All purchases are processed through our secure Buy Button payment system.

Charges are applied as follows:

Connecticut Customers

Customers shipping to Connecticut addresses will be charged:

  • The Product price

  • Connecticut state sales tax (6.35%) as required by law

  • Applicable shipping fees

United States Customers (Non-Connecticut)

Customers shipping to U.S. addresses outside of Connecticut will be charged:

  • The Product price

  • Applicable shipping fees
    No state sales tax is collected unless legally required.

Canada Customers

Customers shipping to Canada will be charged:

  • The Product price

  • Applicable international shipping fees (higher than U.S. rates)

Customers are responsible for any customs duties, GST, VAT, or import taxes imposed by Canadian authorities.

International Customers

Customers shipping outside the United States and Canada will be charged:

  • The Product price

  • Applicable international shipping fees (higher than U.S. and Canada rates)

International customers are solely responsible for any customs duties, import taxes, VAT, or other governmental fees imposed by their country.

Toes First is not responsible for customs delays or additional fees charged by international authorities.

5. Shipping & Delivery

Shipping times may vary by destination.

Toes First is not responsible for delays caused by:

  • Shipping carriers

  • Customs processing

  • Weather conditions

  • Incorrect shipping addresses provided by the customer

Risk of loss transfers to the customer upon delivery confirmation.

6. No Warranty / Disclaimer

The Product is provided “as is” and “as available” without any express or implied warranties.

Toes First disclaims all warranties, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

We do not guarantee that the Product will meet individual expectations.

7. Limitation of Liability

To the maximum extent permitted by law:

  • Toes First shall not be liable for any indirect, incidental, special, or consequential damages.

  • Our total liability shall not exceed the purchase price of the Product.

Use of the Product is at your own risk.

8. Intellectual Property

All website content, product designs, images, branding, logos, and written material are the exclusive property of Toes First and may not be copied, reproduced, or distributed without prior written consent.

9. Governing Law

These Terms are governed by the laws of the State of Connecticut, United States.

Any dispute arising from these Terms or the purchase of the Product shall be resolved through binding arbitration in Connecticut. You waive the right to jury trials and class actions.

10. Modifications

We reserve the right to update these Terms at any time. Continued use of our website or purchase of the Product constitutes acceptance of any changes.
